Jamaal Howard Put to Death in Huntsville Using Pentobarbital
Texas executed 46-year-old Jamaal Howard by lethal injection on Wednesday evening, making him the 30th person put to death across the US in 2026. Pronounced dead at 8:03 p.m. local time at the state prison in Huntsville, Howard became the first inmate executed nationwide since the failed attempt to put Christa Pike to death in Tennessee the previous week.
Before his final hours, Howard was described as chatty
during the 45-mile (70-kilometer) drive from the death row prison to the Huntsville Unit, according to Amanda Hernandez, a spokesperson for the Texas Department of Criminal Justice. He made small talk with the officers through the whole trip,
Hernandez said. Once inside the Huntsville prison, he was taken to a small holding cell near the death chamber and remained talkative. He was asking questions and was very engaged in the process,
Hernandez added.
Howard's execution proceeded after state courts turned down multiple eleventh-hour appeals. His lawyers had raced to block the lethal injection by arguing that Texas planned to use pentobarbital, the exact sedative involved in Pike's botched procedure in Tennessee, where Pike survived two doses.
Legal Arguments Over Degraded Drugs and Intellectual Disability
In filings submitted to the Texas Court of Criminal Appeals, Howard's defense team asserted that the state's execution drugs posed similar risks because Texas planned to inject the same drug used in Pike's attempted execution. The court denied the stay request without elaboration.
Beyond the drug concerns, Howard's legal team pressed a separate claim that he was intellectually disabled and his execution should be halted. The state countered that he has not presented evidence showing he meets the requirements for a claim of intellectual disability.
Crime, Conviction and Final Apology
Howard was convicted of capital murder for the 2000 killing of 42-year-old Vickie Swartout, who was shot once in the chest during a store robbery in Silsbee, a small, rural town about 100 miles (160 kilometers) northeast of Houston. Evidence presented at the trial included the store's surveillance video showing Howard shooting Swartout. Aged 20 at the time of the offense, Howard took $114 and a carton of cigarettes from the store.
When asked by the warden if he had a final statement, Howard addressed his victim's family, who watched through a window. I wish that you accept my apology, and I wish for your forgiveness,
Howard said. I'm sorry for what happened. I wish you can learn to forgive me one of these days.
He also thanked his friends and family and said he loved them, adding he was in a good state of mind to find peace and the Lord, so I thank y'all,
and concluded with, Hey, enjoy life, and peace to y'all.
His sister was among witnesses watching through a window from an adjacent room, becoming distraught, exclaiming several times: Get me out of here,
and being assisted by corrections officers in exiting the witness room.
Wider Fallout From the Tennessee Botch
The execution highlights a growing national scrutiny over lethal injection protocols following the ordeal faced by Christa Pike in Tennessee. The 50-year-old Pike survived after officials administered two sets of syringes containing pentobarbital during the September 30 procedure. Pike was later taken to a hospital, where her legal team revealed that she had regained consciousness and was able to speak. Her attorneys claimed the failed execution caused severe damage to her arms after officials repeatedly struggled to establish IV access, alleging the lethal drug entered surrounding tissue instead of being properly delivered into her bloodstream, leaving her with swelling, burns, and blistering.
Against all odds, Christa Pike is conscious, speaking, and continues to receive critical medical care. Despite the severe damage she endured to her arms, she is still handcuffed and shackled to the bed. Her recovery is medically unprecedented. Her prognosis remains unclear but, at a minimum, we expect a long recovery.

Howard's execution marks the sixth time Texas has carried out capital punishment this year, with two more lethal injections scheduled after Howard. He is the 30th person executed nationwide in 2026.
